1. Acceptance of Terms

These Terms of Service constitute a legally binding agreement between you and West Texas ALS Support Group ("we," "us," "our," or "the Organization"). By accessing our website at https://als-supportgroup.com, participating in our support groups, utilizing our services, or engaging with our advocacy programs, you acknowledge that you have read, understood, and agree to be bound by these terms.

If you do not agree with any part of these terms, you must immediately discontinue use of our website and services. We reserve the right to modify, update, or change these Terms of Service at any time without prior notice. Your continued use of our services following any changes constitutes acceptance of those changes. It is your responsibility to review these terms periodically to stay informed of any updates.

These terms apply to all visitors, users, members, volunteers, and others who access or use our services, whether you are accessing our website from a computer, mobile device, or any other technology platform. By creating an account or participating in our programs, you represent that you are at least 18 years of age or have obtained parental or guardian consent to use our services.

2. Description of Services

West Texas ALS Support Group is a non-profit organization dedicated to providing comprehensive patient support and advocacy services for individuals affected by Amyotrophic Lateral Sclerosis (ALS) and related nerve, muscle, and bone diseases. Our mission encompasses multiple dimensions of care and support designed to improve the quality of life for patients and their families throughout their journey with ALS.

Support Group Services

We facilitate regular support group meetings both in-person and virtually, providing safe spaces where patients, caregivers, and family members can share experiences, exchange practical advice, and find emotional support. These gatherings are led by trained facilitators who understand the unique challenges of living with ALS. Our support groups offer peer-to-peer connections, educational resources, and a compassionate community that understands the physical, emotional, and practical challenges of ALS.

Advocacy and Social Services

Our advocacy programs work to ensure that individuals with ALS have access to necessary medical care, equipment, and social services. We provide guidance on navigating healthcare systems, understanding insurance coverage, accessing disability benefits, and connecting with appropriate medical specialists. Our team assists families in understanding their rights and options, advocating for policy changes that benefit the ALS community, and raising awareness about the disease within the broader community.

Educational Resources and Information

We provide access to current, evidence-based information about ALS, treatment options, clinical trials, and disease management strategies. Our educational materials are designed to empower patients and families with knowledge while maintaining realistic expectations. We regularly update our resources to reflect the latest research and treatment developments in the field of neurodegenerative diseases.

All services are provided free of charge to qualifying individuals and families affected by ALS. We operate as a disease-specific support and advocacy organization, focusing our efforts on serving the West Texas region while maintaining connections with national ALS organizations and research institutions.

3. Medical Disclaimer and Limitations

IMPORTANT: West Texas ALS Support Group is NOT a medical provider and does NOT offer medical advice, diagnosis, or treatment services.

The information, resources, and support we provide are intended for educational and supportive purposes only. Nothing on our website or in our programs should be construed as medical advice or as a substitute for professional medical consultation, diagnosis, or treatment. All medical decisions should be made in consultation with qualified healthcare professionals who are familiar with your individual medical history and circumstances.

While we strive to provide accurate and up-to-date information about ALS and related conditions, medical knowledge evolves rapidly, and individual circumstances vary significantly. We make no warranties or representations about the accuracy, completeness, or timeliness of any information provided through our services. You should always verify any medical information with your healthcare provider before making decisions about treatment or care.

Our support groups and services are designed to provide emotional support, practical guidance, and community connection. They are not therapy sessions and do not replace professional mental health services. If you are experiencing a mental health crisis or emergency, please contact emergency services immediately or call the National Suicide Prevention Lifeline at 988.

By using our services, you acknowledge that you understand these limitations and agree to seek appropriate professional medical and mental health care as needed. We encourage all participants to maintain regular contact with their healthcare team and to discuss any concerns or questions about their condition with qualified medical professionals.

Privacy and Confidentiality

Support group meetings and community interactions often involve sharing personal and sensitive information. You agree to respect the privacy and confidentiality of other participants. Information shared in support groups should not be disclosed to others outside the group without explicit permission. You must not record, photograph, or otherwise document support group sessions without prior written consent from all participants and the Organization.

This indemnification obligation will survive the termination of your use of our services and these Terms of Service. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.

9. Dispute Resolution and Governing Law

Governing Law

These Terms of Service and any dispute or claim arising out of or related to them, their subject matter, or their formation (in each case, including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the State of Texas, United States of America, without giving effect to any choice or conflict of law provision or rule.

Informal Resolution

Before filing any formal legal action, you agree to first contact us at als@als-supportgroup.com and attempt to resolve any dispute informally. We are committed to working with our community members to resolve concerns in a fair and reasonable manner. Most disputes can be resolved through open communication and good faith negotiation.

If we cannot resolve a dispute informally, any legal dispute arising out of or relating to these Terms of Service or our services shall be resolved through binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association. The arbitration shall be conducted in Lubbock County, Texas, or another mutually agreed upon location. The arbitrator's decision shall be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

Class Action Waiver

You agree that any arbitration or legal proceeding shall be conducted on an individual basis and not as a class action, consolidated action, or representative action. You expressly waive your right to participate in a class action lawsuit or class-wide arbitration.

Jurisdiction and Venue

To the extent that arbitration does not apply, you agree that any legal action or proceeding arising out of or relating to these Terms of Service or our services shall be brought exclusively in the federal or state courts located in Lubbock County, Texas, and you consent to the personal jurisdiction of such courts.

10. Termination and Suspension

We reserve the right to suspend or terminate your access to our services at any time, with or without cause, and with or without notice, for any reason including but not limited to violation of these Terms of Service, engaging in conduct that we determine to be harmful to other users or to our organization, or for any other reason at our sole discretion.

You may discontinue your use of our services at any time by ceasing to access our website and notifying us of your desire to terminate your participation in our programs. Upon termination, your right to use our services will immediately cease. However, all provisions of these Terms of Service which by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity obligations, and limitations of liability.

Termination of your access to our services does not relieve you of any obligations or liabilities incurred prior to termination. We are not liable to you or any third party for any termination of your access to our services.

11. Modifications to Terms and Services

We reserve the right to modify, update, or change these Terms of Service at any time. When we make changes, we will update the "Last Updated" date at the top of this page. Severability

If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its intent, or if such modification is not possible, such provision shall be severed from these terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of any other provision of these Terms of Service.

Waiver

No waiver of any term or condition of these Terms of Service shall be deemed a further or continuing waiver of such term or condition or any other term or condition. Our failure to assert any right or provision under these Terms of Service shall not constitute a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms of Service or your rights and obligations under them, in whole or in part, without our prior written consent. We may assign these Terms of Service and our rights and obligations under them at any time without notice to you.
